Use the driving card of a third to get rid of the withdrawal of points. The practice is so common that it is possible to find ads in digital purchase and sale spaces, such as Milanuncios. That is what a driver did in 2015. Now, the Supreme Court has settled its case and has bad news.
Identification. When on a highway or highway we circulate above 150 km/h, the driver risks the withdrawal of two to six points of the driving card. The economic amount exceeds, in these cases, 200 euros and can reach 600 euros.

The situation can be much more harmful for those who work at the expense of maintaining an active driving license, such as a delivery man. It is not strange, therefore, that in digital purchase spaces we come to find ads in which the purchase of other people’s driving card is proposed for an amount that, in some cases, reaches 1,000 euros per retired point .
Documentary falsehood. The maneuver is recurring because, as the fixed radars “hunt” the vehicle behind, it is difficult to confront the version that a 90 -year -old was not the one after the steering wheel of a car that has registered a speed of 160 km/ h.
However, it has many risks since those who endorse their points to the license of a third party will be incurring a crime of documentary falsehood, which multiplies the problems in case justice discover that we are trying to deceive them. It is what happened to this León driver.
15,000 euros of fine. The case of this man was recorded in 2015. Then, he was sanctioned for speeding with a punishment that forced the withdrawal of points. To avoid this, he registered his 82 -year -old father as a offender. Paid the fine, everything should have been left in what often happens: a hoax to the administration.
This case, however, is particular because the driver did not maintain a good relationship with his father who, upon learning of the trick, denounced the driver, explain in The country. Now, a decade later, the Supreme Court has reaffirmed in the sentence imposed by lower instances: 15,000 euros of fine and a nine -month prison sentence.
The Supreme Court ensures that the driver lacked the truth when answering the requirement of the sanction and is reaffirmed in the conviction of the Provincial Court of León, who alleged that there had been a crime of documentary falsehood.
Inconsistencies. To defend himself, the driver claimed that during the previous years, justice has not followed a specific jurisprudence. Likewise, he assured that in his way of acting there was an “ideological falsehood” or, what is the same, missing the truth in the narration of the facts.
However, the Supreme Court ensures that this is not true. They understand that when the driver’s registration is falsified, an alteration of the document itself occurs. Thus, this makes the “document in its entirety constitute a fallacy”, while recalling that it has produced direct damage to the figure of the father.
