Shoppers to get share of $3.6m advertising settlement – no proof is needed

SHOPPERS are in line to get a share of a massive $3.6 million advertising settlement – and you don’t need any proof to apply.

The class action covers a multitude of products, meaning that even more Americans can submit an application.

Similasan is a homeopathic remedy business that sells a range of eye drops in pharmacies like CVS or Walgreens.

The company is being held liable for claims that it deceptively labeled its drops as homeopathic.

The practice of homeopathy means to stimulate healing responses to diseases by administering substances that mimic the symptoms of those diseases in healthy people.

Homeopathy is an alternative branch of medicine that has been disputed within medical science.

The eye drops named in the suit also allegedly misleadingly market themselves as “sterile” and fail to disclose the risk of silver sulfate.

Any eye drop used must be sterile in order to prevent against infections.

The suit against Similasan names several of its products, including:

  • Similasan Dry Eye Relief
  • Similasan Complete Eye Relief
  • Similasan Allergy Eye Relief
  • Similasan Kids Allergy Eye Relief
  • Similasan Red Eye Relief
  • Similasan Pink Eye Relief
  • Similasan Kids Pink Eye Relief
  • Similasan Aging Eye Relief
  • Similasan Computer Eye Relief
  • Similasan Stye Eye Relief
  • Similasan Pink Eye Nighttime Gel
  • Similasan Dry Eye Nighttime Gel
  • CVS Pink Eye Drops
  • Walgreens Stye Eye Drops
  • Walgreens Pink Eye Drops
  • Walgreens Allergy Eye Drops.

WHO IS ELIGIBLE TO CLAIM?

The lawsuit benefits customers who purchased Similasan homeopathic eye drops or private-label homeopathic eye drops for personal use.

This is specifically targeted at those who bought these products from either CVS or Walgreens between September 11, 2017 and February 20, 2025, per Top Class Actions.

It is important to note that Similasan has not admitted to any wrongdoing, but is paying out the cash to shoppers regardless.

This is to settle the claims before it goes to trial.

WHO MUCH CAN YOU GET?

Under the terms of the settlement, customers are eligible for a cash payment based on the number of products from the noted list with a proof of purchase.

Without proof of purchase, like a receipt or product packaging for example, customers can only claim a lot less.

If you do not have physical proof to show that you were effected, you can only claim damages for up to four products, receiving $2.50 per product.

What’s a class-action settlement?

Class action lawsuits offer groups of people, or ‘classes,’ a way to band together in court.

These suits are often brought by one or a few people who allege a company or other entity has wronged a large group of people.

When a suit becomes a class action, it extends to all “class members,” or people who may have similar complaints to those who filed the suit.

Companies often settle class actions – offering payment to class members who typically waive their right to pursue further legal action by accepting money.

These payout agreements frequently include statements by the defendant denying wrongdoing. Companies tend to settle class actions to avoid the costs of further litigation.

Pollution, discrimination, or false advertising are a few examples of what can land a class action on a company’s doorstep.

This means you will only get $10.

If you do have proof of purchase, class members can claim on an unlimited amount of covered products, also receiving $2.50 for every one you bought.

The payments will be given out on a proportional basis per how many claims are made with proof of purchase.

This means the less people that come forward with proof, the more cash you will receive.

WHEN IS THE DEADLINE?

Those who believe they are entitled to reimbursement are encouraged to apply quickly.

If you do not submit a form by the set deadline, you will lose out completely.

Any funds that remain in the settlement after payments are distributed will be donated to The Public Justice Foundation.

The deadline for exclusion and objection is May 27, 2025 and the approval hearing is July 17, 2025.

The absolute deadline to file a form is October 15, 2025.

It is important to stress that even if you do not have proof of purchase, there is still cash to be made here.
