AMERICANS could grab $3,000 checks from a gun holster data breach settlement – and there are two ways to get payments.
Crossbreed Holsters agreed to a whopping $195,000 class action lawsuit settlement to resolve claims it failed to prevent a data breach in 2022.
The settlement will benefit individuals who received a data breach notice from Crossbreed Holsters telling them of the data breach which the company discovered on December 5, 2022.
The data breach class action lawsuit claims Crossbreed Holsters failed to protect consumer information from the breach.
It also allegedly compromised sensitive information like personal identifiers and financial account numbers.
Crossbreed Holsters is a gun holster company that sells holsters for various gun models.
The company hasn’t admitted any wrongdoing but agreed to a $195,000 settlement to resolve the data breach class action lawsuit.
HOW MUCH YOU COULD GET
Under the settlement, class members can receive compensation for documented ordinary data breach-related expenses like bank fees, communication charges, travel expenses and credit-related costs.
The large payment can be combined with up to three hours of lost time at a rate of $35 per hour – meaning you could receive a total reimbursement of $500 for ordinary expenses and lost time.
Class members who had extraordinary losses as a result of the data breach can receive a larger payment of up to $2,500 for un-reimbursed, documented financial losses that were more likely than not caused by the data breach.
This reimbursement category may include damages such as fraud or identity theft.
Class members who didn’t experience any out-of-pocket losses can opt to receive an alternative cash payment instead of reimbursement.
The payments vary depending on how many claims filed with the settlement.
Currently no payment estimates are available.
Crossbreed Holsters also agreed to improve its data security measures to protect consumer information better.
ARE YOU ELIGIBLE?
Those who received a data breach notification informing that their information may have been compromised in the Crossbreed Holsters data breach discovered December 5, 2022 are eligible.
You must fill out the claim form, and also have documentation of out-of-pocket losses like bank statements, phone bills and receipts, to name a few.
WHAT ARE THE DEADLINES?
The deadline for exclusion and objection is set for January 9, 2025.
The final approval hearing for the settlement is scheduled for March 11 of this year too.
A valid claim form must be submitted by class members by January 9, 2025 to receive settlement benefits.
What’s a class-action settlement?
Class action lawsuits offer groups of people, or ‘classes,’ a way to band together in court.
These suits are often brought by one or a few people who allege a company or other entity has wronged a large group of people.
When a suit becomes a class action, it extends to all “class members,” or people who may have similar complaints to those who filed the suit.
Companies often settle class actions – offering payment to class members who typically waive their right to pursue further legal action by accepting money.
These payout agreements frequently include statements by the defendant denying wrongdoing. Companies tend to settle class actions to avoid the costs of further litigation.
Pollution, discrimination, or false advertising are a few examples of what can land a class action on a company’s doorstep.
