The musician is serving a 30-year prison sentence in a North Carolina jail for racketeering and sex trafficking.
According to his attorney, he was put into solitary confinement on June 10 and locked up with anxiety medication.
He was given further medications and directed to take them, the filing said.
Three days later, Kelly reported feeling “faint” and “dizzy” – and reported seeing “black spots in his vision” – before he passed out and was rushed to nearby Duke University Hospital.
His legal team allege his ill health was as a result of being given dangerously-high quantities of medication.
The reports of an overdose come just days after his attorneys accused prison officials of throwing him in solitary confinement as punishment for filing an emergency motion.
Kelly reportedly filed the motion to escape death threats from what he believed to be white supremacists inside the prison.
